Expense for indemnitee's defense cost outside of policy limit

The typical policy form provides for Expense for indemnitee's defense cost inside the limits of coverage.

This could be a valuable coverage extension or an added incentive to increase excess/ umbrella coverage.

Non-Accumulation of Liability Wording

Coverage is typically granted for bodily injury and property damage arising out of an occurrence as defined in the policy. This language intends to limit coverage for an incident or event that would otherwise been covered by multiple policies to one policy. This language will cause an occurrence form to respond like a claims made form in situations where a claim is or should have been covered by a prior policy.

This policy language should be avoided if at all possible as is seriously reduces the limits available to pay such claims especially in continuous trigger liability states. Beware, contractors!
